BatchDog Terms of Service

Version: draft 10 · Effective date: {{EFFECTIVE_DATE}}

These terms are the agreement between you and Maksim Paleyeu, a self-employed sole trader (autónomo) registered in Spain trading as "Relax Games Studio" ("we"), NIF Z2207759V, Calle Sant Ignasi de Loiola 27, piso 4, puerta 10, 46008 Valencia, Spain, about using BatchDog in Telegram, on the web and in our mobile apps. By using BatchDog you accept these terms. How we handle personal data is described in the Privacy Policy.

1. Who can use BatchDog

You must be at least 18 to have your own BatchDog account, to accept these terms and to buy BatchDog+, wherever you live; the app asks you to confirm your age on the first screen. Children and teenagers can be added to a family by an adult without their own account; the adult is responsible for that data (see Privacy Policy, section 9).

2. What BatchDog is

BatchDog helps a family plan menus, cook in batches, keep a pantry, make shopping lists, and keep a food diary and weight log. Batchy, a dog character, reacts to how you eat. Some features use artificial intelligence (section 8).

BatchDog is a free app with an optional paid plan, BatchDog+, which covers the whole family. What is included in each plan and the limits (for example, how many days of AI menus you can make) are shown in the app before you buy. AI menus are counted in menu days: a menu for 1 day uses 1 day, a menu for 7 days uses 7. On the free plan you get 14 days of AI menus in total, up to 7 days per menu. We may change the free features and limits; we will not reduce what you already paid for during a paid period.

3. Your account and your family

You sign in with Telegram (and later with other sign-in options in our apps). On the web and in our apps you can sign in to the same account with a one-time code from our Telegram bot; never give this code to anyone. Keep access to that account safe: whoever controls it controls your BatchDog account. You can create a family or join one by invitation. Family members share the pantry, recipes, menus and shopping list and can see each other's profiles (see the Privacy Policy). Invite only people you trust. When you leave a family or delete your account, the shared content stays with the family.

4. BatchDog+ subscription

Price. The price, the billing period and what you get are shown before you pay, including taxes where they apply. In Telegram the current prices are 500 Stars every 30 days and 3,990 Stars for 12 months; the first 500 families pay an early-family price of 299 Stars every 30 days, which they keep as long as each renewal goes through within 48 hours of its due date. Amounts in euros or dollars shown next to Stars are approximate, because the price of Stars depends on where you buy them. BatchDog+ applies to your whole family while you are a member.

What you get. 60 days of AI menus for the family in every 30-day period (counted from the start of your subscription; unused days do not carry over), up to 31 days per menu, up to 6 adults with an account in the family, and recipe import from a link or a photo. If you paid for BatchDog+ under the earlier terms ("15 AI menus a month"), those limits stay until the end of the period you paid for (a whole year for the 12-month plan): 15 AI menus in every 30-day period, up to 60 days each.

Where you pay. You pay through the platform you use, and its terms also apply:

PlatformHow you payHow to cancelRefunds
TelegramTelegram StarsTelegram → Settings → My Stars → your subscription → CancelThrough us, see section 6; we return Stars through Telegram
iPhone and iPadApple In-App PurchaseiPhone Settings → your name → SubscriptionsApple handles refunds: reportaproblem.apple.com
AndroidGoogle Play BillingGoogle Play → Payments & subscriptions → SubscriptionsGoogle's refund policy applies; you can also ask us
WebCard through StripeProfile → BatchDog+ → Cancel subscriptionThrough us, see section 6

One BatchDog+ on every platform. BatchDog+ belongs to your family, not to a device or an app store. Wherever it was bought, it works in Telegram, on the web and in our apps once you sign in to the same account (section 3). You manage, cancel and ask for refunds where you bought it, as in the table above: a Telegram Stars purchase only in Telegram, an App Store or Google Play purchase only with that store. Not every way to pay is offered on every platform or in every country: Telegram Stars can be used only inside Telegram, and some versions of our apps do not sell BatchDog+ at all; the BatchDog+ screen says what is available to you. A family has one BatchDog+: buying it on another platform does not add a second one. If the family ends up paying on two platforms at once (for example, two family members subscribed in different places), write to us (section 6) and we will help you cancel the payment you do not need.

Automatic renewal. The monthly plan is a subscription with no fixed term that renews automatically every 30 days and is charged at the same price you agreed to when you subscribed (in Telegram: the same number of Stars) until you cancel. The minimum term is 30 days; after that you can cancel at any time, and a cancellation takes effect at the end of the current 30-day period. You can cancel at any time in the app: tap "Cancel subscription" in Profile, choose the type of cancellation, check the details and tap "Cancel now"; the bot confirms with the date and time of your cancellation and the day the contract ends. You can also cancel in Telegram (Settings → My Stars → your subscription → Cancel). The 12-month plan does not renew; in the same place you can terminate it early for good cause, and our support reviews the reason and replies. Cancelling stops all future charges; you keep BatchDog+ until the end of the period you have already paid for, and that period is not refunded except as described in sections 5 and 6. The price of an active Telegram subscription cannot change: if we change our prices, your current subscription keeps its price, or we end it at the end of a paid period after telling you at least 7 and no more than 30 days in advance, and you are only charged the new price if you choose to subscribe again. On other platforms we tell you about a price change at least 7 and no more than 30 days before it applies, with instructions on how to cancel, and ask for your consent where the law requires it. The bot reminds you 16 days before each renewal of its date and amount and how to cancel (for consumers in Spain this reminder is required by Art. 97.1(p) TRLGDCU); so you also get it more than once a year. These reminders come even if you turned off other reminders.

The 12-month plan in Telegram is a single payment for 12 months and does not renew automatically. In the app stores and on the web, a yearly plan may be an auto-renewing subscription; the purchase screen says which.

Introductory offers. If we offer a special price (for example for early families), the conditions, including how long it lasts and what happens when it ends, are shown before you buy.

How the contract is made. You choose a plan, read these terms, tick the boxes and press the payment button; Telegram then shows the price for your final confirmation, and until then you can go back or correct your choice. We keep a record of your purchase and of the version of these terms you accepted, and the bot sends you a copy (section 5). The contract can be concluded in English, Spanish, German, French, Italian, Portuguese or Russian: you accept these terms in the language of the app, and that language version is the one that applies to you.

4a. AI menu day packs

What a pack is. A day pack is a one-off purchase of extra AI menu days for your family: 15 or 30 days. It is not a subscription and does not renew. You can buy one with or without BatchDog+. The days go to your family's balance on top of your plan, and every adult in the family can use them. If you move to another family while you are the only member of yours, the pack days move with you; if other members stay, the days stay with that family.

Price. The price is shown before you pay and depends on your family's plan at that moment. In Telegram: without BatchDog+, 175 Stars for 15 days and 300 Stars for 30 days; with BatchDog+ (the subscriber price), 100 Stars and 175 Stars. If your plan changes between the price being shown and the payment, Telegram declines the payment and you see the new price.

How the days are used. AI menus use your plan's days first and pack days only after that, older packs first. Pack days do not expire and do not reset with your plan's 30-day period: they stay on the balance until they are used. A single menu is still limited to your plan's maximum length (7 days on the free plan, 31 with BatchDog+). If a menu cannot be made, its days go back to where they were taken from.

The subscriber price depends on BatchDog+. If you withdraw from a BatchDog+ purchase (section 5) or that payment is refunded, the remaining days of each pack bought at the subscriber price while that BatchDog+ payment was active are recalculated at the regular price: remaining days × price paid ÷ regular price of the same pack, rounded down. For example, 15 unused days bought for 100 Stars become 8 (15 × 100 ÷ 175). Packs bought at the regular price are not affected. Before you confirm a withdrawal, the app shows how many days will remain; the bot's confirmation repeats it.

4b. Invite a friend

Bonus days for an invite. You can invite friends with your personal link in the app (Profile). When someone who has never used BatchDog opens your link, creates an account and makes their first AI menu, your family and theirs each get 7 bonus AI menu days. A friend counts once ever, and only for the first invite link they opened. Inviting yourself does not count, and neither does someone in your own family: joining your family through a family invite before the bonus is given is not a friend's invite; a bonus already given stays if the friend joins your family later. Your family gets bonus days for at most 10 friends in any 30 days; above that limit your friend still gets their 7 days.

What bonus days are. Bonus days are used like pack days (section 4a): after your plan's days, older ones first. They do not expire and are not recalculated if you withdraw from BatchDog+. They are a free extra with no cash value: they cannot be exchanged for money or refunded. We may remove bonus days, or stop counting invites, that were obtained through abuse, for example with fake or duplicate accounts. We may change or end the invite programme for the future; bonus days you already received stay on the balance.

5. Right of withdrawal

Wherever you live, you may withdraw from a BatchDog+ purchase within 14 days of buying it, without giving a reason, and get the full payment back. For consumers in the EU and the EEA this is also a statutory right (Directive 2011/83/EU; in Spain Arts. 102–108 TRLGDCU). The period ends at the end of the 14th day after the day of purchase, or of the next working day if that day is a weekend or public holiday; we always accept withdrawals until the end of the 20th day after the day of purchase (UTC), so weekends, holidays and time zones never shorten it.

How. Tap "Withdraw from contract here" in Profile (always there; during the withdrawal period Profile shows the last day), check the purchase details and tap "Confirm withdrawal", or send a clear statement to hello@relaxgames.studio. You can use the model withdrawal form below, but you don't have to. We confirm the withdrawal on a durable medium right away: the bot sends a message with the date and time of your withdrawal, the purchase and the amount (an email gets an email reply).

Model withdrawal form (complete and return it only if you wish to withdraw from the contract):

To Maksim Paleyeu (Relax Games Studio), Calle Sant Ignasi de Loiola 27, piso 4, puerta 10, 46008 Valencia, Spain, hello@relaxgames.studio: — I/We (\) hereby give notice that I/We (\) withdraw from my/our (\) contract for the provision of the following service (\): BatchDog+ — Ordered on (\*) — Name of consumer(s) — Address of consumer(s) — Signature of consumer(s) (only if this form is notified on paper) — Date

(\*) Delete as appropriate.

Copy of the contract. After each purchase the bot sends you a file to keep: the purchase confirmation, these terms in the version you accepted, the withdrawal information with the model form and the legal guarantee (section 6a), in the language of the app.

Immediate start. At checkout we ask you to confirm this:

I have read and agree to the Terms of Service. I want BatchDog+ to start now; if I withdraw within 14 days of buying, I get the full payment back.

What we refund. If you withdraw, we refund the full payment, with nothing kept for the days you already had BatchDog+, and BatchDog+ from that purchase ends right away; the subscription no longer renews. If Telegram charged a renewal after you withdrew, we refund it too. We refund at once, and no later than 14 days after receiving your withdrawal, by the same payment method (for Telegram: in Stars to your Telegram balance). The right covers the first payment of a subscription and the 12-month plan; subscription renewals are not new contracts and are cancelled as described in section 4.

AI menu day packs (section 4a). You can withdraw from a pack purchase within 14 days too, but its days are available right away. At checkout we therefore ask for your express consent:

Please make the pack’s days available right away. I understand that I lose my right of withdrawal as soon as the first day of the pack is used; until then, if I withdraw within 14 days, I get the full payment back.

With this consent your right of withdrawal ends as soon as the first day of the pack is used for an AI menu (Art. 16(m) of Directive 2011/83/EU; in Spain, Art. 103(m) TRLGDCU). Until then, if you withdraw, we refund the full payment and remove the pack's days from your balance; BatchDog+ and your subscription do not change. Days that came back after a menu could not be made do not count as used. If you did not give this consent, you keep the right of withdrawal for the full 14 days.

Purchases through Apple or Google are refunded by them under their rules; for those purchases please ask Apple or Google first. We will help if they cannot.

6. Refunds and payment support

If something goes wrong with a payment (you were charged but did not get BatchDog+, you were charged twice, or BatchDog+ did not work because of a fault on our side), contact us: in Telegram send /paysupport to the bot, or write to hello@relaxgames.studio. Include the date, the amount and your username. We reply within 3 business days, give every complaint a reference number and resolve it within 15 days at most. Telegram's support does not handle purchases made in bots, so please contact us first. If you believe we wrongly refused a refund, you can report it to Telegram as described in the Telegram Stars Terms of Service.

Apart from the withdrawal right, the legal guarantee (section 6a) and any other rights you have under consumer law, payments for periods already started are not refundable, but we will consider every request fairly. Payments in Telegram Stars are refunded in Stars.

6a. Legal guarantee

As a consumer you have the legal guarantee of conformity for digital services (Directive (EU) 2019/770; in Spain Arts. 114 ff. TRLGDCU). We are responsible for any lack of conformity that occurs or becomes apparent during the whole time BatchDog+ is supplied to you. You can ask us to bring BatchDog+ into conformity free of charge; if that is impossible, disproportionate or not done within a reasonable time, you can ask for a proportionate price reduction or end the contract and get back the part of the price for the period in which BatchDog+ did not conform. Payments in Telegram Stars can only be refunded in full, so wherever part of the price is due back to you, for a payment in Stars we refund the whole last payment.

7. Not medical advice

BatchDog is a cooking and wellness tool, not a medical service or medical device. Calorie targets, menus, nutrition figures, warnings about allergens, conditions and medications, and Batchy's reactions are general information, not a diagnosis or treatment.

8. AI-generated content

Menus, recipes, recipe imports, cooking plans and nutrition figures are created with artificial intelligence (a model from our AI model provider, named in Subprocessors) and are marked as AI-generated in the app. AI can be wrong: quantities, calories, cooking times and storage advice may be inaccurate, and a menu may contain something you asked to avoid. Check what you cook, follow food safety rules (especially how long batch-cooked food can be kept) and use your judgement. You are responsible for how you use AI output.

9. Acceptable use

Do not:

How we moderate. What you add to BatchDog is visible only to you and your family. We do not check it in advance and do not use automated tools to remove content or restrict accounts. We look at content only when someone reports it to us or when we notice a breach of these terms, and a person makes the decision. We act diligently, objectively and in proportion, taking into account the rights and interests of everyone involved; for a minor breach we warn you first.

Reporting illegal content. If you think something in BatchDog is illegal, write to hello@relaxgames.studio and tell us why you think it is illegal, where exactly it is (for example the recipe name or a screenshot), your name and email address, and that you believe in good faith that your report is accurate and complete (name and email are not needed for reports of child sexual abuse material). We confirm receipt, decide in a timely, careful and objective way, and tell you what we decided and how you can challenge it.

What we may do. If you break these rules, we may remove or disable content, limit features, suspend or close your account. If we do, we tell you without undue delay, at the latest when the restriction takes effect: what we decided and for how long, the facts and circumstances, whether automated means were used, which rule of these terms or which law it is based on, and how you can challenge it. We leave this out only where the law or an authority forbids telling you. You can challenge a decision by replying to it or writing to hello@relaxgames.studio: a person reviews it again and tells you the result. You can also go to the out-of-court bodies and courts described in section 15. If we close your account without fault on your part, we refund the unused part of any prepaid period (for Telegram Stars, the whole last payment).

Point of contact. Our single point of contact for users and for authorities of the EU member states and the European Commission under the Digital Services Act (Regulation (EU) 2022/2065, Arts. 11–12) is hello@relaxgames.studio; you can write to it in Spanish, English or Russian.

10. Your content

What you enter (recipes, notes, photos, pantry lists) remains yours. You give us a non-exclusive, worldwide, royalty-free licence to store, process and show it to you and your family, only to provide and improve BatchDog; we do not use your content to train AI models. The licence ends when you delete the content or your account, except for content that stays with your family as described above. When you import a recipe from a website, it is for your personal use; respect the rights of its author.

11. Our rights

BatchDog, its design, the Batchy character, artwork and software belong to us or our licensors. You may use them only inside BatchDog, for personal, non-commercial purposes.

12. Availability and changes

We work to keep BatchDog available but cannot promise it will always work without interruption or errors; some features are marked as test or beta.

Changes to BatchDog+. We change BatchDog+ only for a valid reason: security, a change in the law or a decision of an authority, a change made by Telegram or an app store, or a technical or service improvement. A change never costs you anything extra, and we tell you clearly and in advance, in the bot, what changes and when. Within a period you have already paid for, we do not reduce the AI menu days or other features included in BatchDog+ (section 2), unless security, the law or a platform change that we cannot avoid makes it necessary. If a change reduces your access to or use of BatchDog+ more than slightly, you may end the contract free of charge within 30 days of the change or of being told about it, whichever is later, and we refund the part of the price for the remaining paid period (for Telegram Stars, which cannot be refunded in part, the whole last payment); this right does not apply if we let you keep BatchDog+ without the change at no extra cost. To use it, tap "Cancel subscription" in Profile and choose "Extraordinary, for good cause", or write to hello@relaxgames.studio.

Closing BatchDog or a paid feature. If we close BatchDog or a paid feature, we will tell you at least 30 days in advance and refund the unused part of any prepaid period (for Telegram Stars, the whole last payment).

13. Ending the agreement

You can stop using BatchDog and delete your account at any time in Profile → Data & privacy → Delete account. Deleting your account does not cancel a subscription made through Apple or Google; cancel it there. We may end these terms for a serious or repeated breach, with notice where possible; section 9 explains how we tell you why and how you can challenge it.

14. Liability

Everyone. Nothing in these terms excludes or limits liability that the law does not allow to be excluded or limited, including liability for intent or gross negligence, for fraud and for death or personal injury caused by negligence, or your statutory rights as a consumer, including the legal guarantee (section 6a). We are not responsible for the services of Telegram, Apple, Google or other platforms, which they provide under their own terms, or for loss to the extent that it was caused by not following sections 7 and 8.

Consumers in the EU, the EEA, the UK and Switzerland. We are liable under the statutory rules of the country where you live. These terms do not cap or otherwise limit that liability.

If you live in the United States. TO THE FULLEST EXTENT PERMITTED BY LAW, BATCHDOG IS PROVIDED "AS IS" AND "AS AVAILABLE", AND WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, AND OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO BATCHDOG IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND US$50. THESE LIMITS DO NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, TO FRAUD, OR TO RIGHTS UNDER YOUR STATE'S LAW THAT CANNOT BE WAIVED OR LIMITED; IF YOUR STATE DOES NOT ALLOW A LIMIT, THAT LIMIT DOES NOT APPLY TO YOU.

Elsewhere we are liable under the law that applies to you; within what that law allows, we are not liable for losses that were not foreseeable when you accepted these terms.

15. Law and disputes

These terms are governed by Spanish law. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts of your place of residence. For consumers in Spain this includes the General Law for the Defence of Consumers and Users (TRLGDCU, Royal Legislative Decree 1/2007). Please contact us first at hello@relaxgames.studio; most problems can be solved quickly. If you live in the EU, you can also get free help from the European Consumer Centre of your country. Section 18 adds rules for consumers in some countries outside the EU. We have not joined the Spanish consumer arbitration system (Sistema Arbitral de Consumo) or any other alternative dispute resolution scheme, and no law obliges us to. If we cannot resolve your complaint, our answer names an accredited dispute resolution body that can deal with it, such as the consumer arbitration board (Junta Arbitral de Consumo) of the Comunitat Valenciana or of your region, and says whether we agree to take part (Spanish Law 7/2017). If you live in the Comunitat Valenciana, you can also ask us by email for an official complaint form (hoja de reclamaciones).

16. Platforms

Telegram, Apple and Google are not parties to these terms and are not responsible for BatchDog or its content, its support or claims about it. If you downloaded BatchDog from the App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you; Apple has no obligation to provide maintenance or support for BatchDog. If BatchDog fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any, to the extent the law allows.

17. Changes to these terms

We may update these terms for the reasons listed in section 12 or to describe new features. We tell you about every change at least 30 days before it takes effect, in the app or through the bot, with the new text and a summary of what changes.

18. Additional terms for your country

The rules below apply to you if you live in the country named. They add to sections 1–17; where they give you more rights, they take precedence.

Where BatchDog is offered

We offer BatchDog in the countries where the App Store or Google Play lists it, and in Telegram and on the web to people who live in those countries. In Russia, BatchDog is available only in Telegram. We do not offer BatchDog in the United Kingdom or Switzerland at the moment, nor in mainland China or in countries and regions under comprehensive EU, UN or US sanctions, and you may not use it if you are subject to such sanctions. If you live in a country where BatchDog is not offered, please do not create an account or buy BatchDog+; we may refuse to create an account or to sell BatchDog+ when you connect from such a country. If you move to a country where BatchDog is not offered, you can still download and delete your data (Privacy Policy, section 7).

United Kingdom

BatchDog is not offered in the United Kingdom at the moment (see above). If you use it while living there anyway, nothing in these terms limits the rights that UK consumer law, such as the Consumer Rights Act 2015, does not allow a contract to exclude.

Australia and New Zealand

Australia. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. If a failure does not amount to a major failure, you are entitled to have it fixed in a reasonable time, and if this is not done, to cancel the contract and get a refund of the unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage caused by a failure. Section 14 does not limit these rights.

New Zealand. The Consumer Guarantees Act 1993 and the Fair Trading Act 1986 apply to you, and nothing in these terms limits your rights under them.

Canada

Nothing in these terms limits your rights under the consumer protection law of your province. Quebec: the Consumer Protection Act applies. Clauses that exclude or limit our liability, or that let us change the contract, apply to you only as far as that Act allows, and you keep the rights to cancel a distance contract under its sections 54.8 and 54.9. If you live in Quebec, we give you these terms and the related documents in French first; you can choose another language version only after that, and the French version stays available to you.

Brazil

The Consumer Defence Code (CDC, Law 8,078/1990) applies. Your 14-day right of withdrawal in section 5 includes the 7-day right of regret of Art. 49 of the CDC. You can bring a claim in the courts of your domicile (Art. 101). Section 14 does not limit liability that the CDC does not allow to be limited.

Japan

Notation under the Specified Commercial Transactions Act (特定商取引法に基づく表記):

Under the Consumer Contract Act, clauses that fully exclude our liability or unfairly limit your rights do not apply to you.

South Korea

The Act on Consumer Protection in Electronic Commerce applies. Your 14-day right of withdrawal in section 5 includes the 7-day withdrawal right under that Act. We tell you about a price increase, or about a free trial turning into a paid subscription, at least 30 days in advance and apply it only with your consent. You can bring a dispute to the Korea Consumer Agency or the E-Commerce Mediation Committee.

India

The Consumer Protection Act 2019 and the Consumer Protection (E-Commerce) Rules 2020 apply. Our grievance officer is Maksim Paleyeu, hello@relaxgames.studio; we acknowledge a complaint within 48 hours and resolve it within one month. You can also contact the National Consumer Helpline or a consumer commission.

Turkey

The Consumer Protection Law No. 6502 and the Distance Contracts Regulation apply; your right of withdrawal is in section 5. You can bring a dispute to the consumer arbitration committee or the consumer court where you live, within their monetary limits.

United States: automatic renewal

Section 4 sets out our automatic renewal terms for California's Automatic Renewal Law and similar laws of other states. Before you subscribe we show them clearly next to the payment button and ask for your affirmative consent; after you subscribe we confirm them, with how to cancel, in a form you can keep; you can cancel online as easily as you subscribed; and we remind you before each renewal and tell you about a material change in advance, as described in section 4.
